Terms of Service

Pitch is a web-based football management platform for grassroots coaches, managers, and clubs. It provides tools for squad management, training planning, match analysis, and player development tracking. The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability or the accuracy of any content, analysis, or recommendations generated by the Service.

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@getpitch.pro if you suspect unauthorised access. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

You agree not to:

• Use Pitch for any unlawful purpose or in violation of these Terms.
• Upload content that infringes third-party intellectual property rights.
• Attempt to gain unauthorised access to other users' or clubs' data.
• Scrape, reverse-engineer, decompile, or create derivative works from the Service.
• Transmit malware, spam, or any content that is harmful, offensive, or illegal.
• Use the Service in a way that could damage, overload, or impair our infrastructure.

We reserve the right to suspend or terminate access for any violation of these rules without notice.

You retain full ownership of all data you enter into Pitch, including player profiles, training sessions, and match records. By using Pitch you grant Digital Empower a limited, non-exclusive, royalty-free licence to store, process, and display that data solely to provide and improve the Service. Where you enter personal data about third parties (including players, some of whom may be minors), you represent and warrant that you have the appropriate legal basis (including parental consent where required by applicable law) to enter and process such data. You are solely responsible and liable for all data you enter. We accept no liability for the accuracy, completeness, or legality of data entered by users.

Pitch uses artificial intelligence to generate training programmes, tactical recommendations, drill suggestions, match insights, and player analysis. AI-generated content may be inaccurate, incomplete, or unsuitable for your specific situation. You should always review and verify AI output before applying it to your coaching, training, or match preparation. All AI-generated content is provided for informational and inspirational purposes only. It does not constitute professional coaching, medical, or legal advice. You are solely responsible for decisions made based on AI-generated content. We expressly disclaim any liability for harm arising from reliance on AI output. AI features may change, be updated, or be removed at any time.

Certain features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are stated exclusive of applicable taxes (including Dutch VAT / BTW), which will be added at checkout where applicable. We reserve the right to change pricing with at least 30 days' notice to existing subscribers. Price changes take effect at the next renewal date. No refunds are provided for partial billing periods, except where required by mandatory applicable law.

If you are a consumer (not purchasing as a business), you may have a statutory right of withdrawal of 14 days under EU and Dutch law (Article 6:230o Dutch Civil Code). However, by activating a paid subscription or commencing use of a paid feature, you explicitly request immediate performance of the contract and acknowledge that you lose your right of withdrawal once performance has commenced. This waiver is confirmed at the point of purchase.

We offer a free tier subject to usage limits (teams, players, and features). We may modify free-tier limits at any time with reasonable notice (at least 30 days for reductions that affect active free users). Continued use after the effective date of any change constitutes acceptance of the updated limits.

Pitch and its content, features, and functionality (excluding your data) are owned by Digital Empower and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding, trademarks, or product name without prior written permission. Nothing in these Terms transfers any intellectual property rights to you.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We are not responsible for any decisions (tactical, developmental, or otherwise) made by coaching staff based on data or recommendations within Pitch. These disclaimers do not affect any mandatory statutory rights you may have as a consumer under Dutch or EU law.

To the fullest extent permitted by applicable law, Digital Empower shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total aggregate liability to you for any and all claims arising from these Terms or the Service shall not exceed the total amount you paid us in the 12 months preceding the event giving rise to the claim, or €50, whichever is greater. These limitations do not apply to liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under mandatory applicable law.

You may cancel your account at any time via the Settings page. We may suspend or terminate your access immediately for material breach of these Terms, including but not limited to violation of Section 3 (Acceptable use) or non-payment. Upon termination, your data is retained for 90 days and then permanently deleted, unless you request earlier deletion or retention is required by law.

These Terms are governed by the laws of the Netherlands. In the event of a dispute, we encourage you to contact us first at support@getpitch.pro. If we cannot resolve the dispute amicably, both parties submit to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, without prejudice to your mandatory rights as a consumer under the laws of your country of residence.

We may update these Terms from time to time. We will notify you via email or in-app notice at least 14 days before material changes take effect. Continued use of Pitch after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your account before the effective date.
